(a) Whoever violates any of the provisions of this chapter shall be fined not more than one hundred dollars ($100.00). A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

(b) In addition to the penalty provided in subsection (a) hereof, whoever is in violation of any of the provisions of this chapter shall forthwith change the sidewalk to conform to the procedure and provisions of this chapter. If such change is not made, then upon notice by the Clerk-Treasurer, the Village shall have the right to have such change made as it deems proper at the expense of the landowner, such expense to be certified to the County Auditor and charged on the tax duplicate of such landowner on whose premises the change is made.
