1024.05 REFUND OF DEPOSIT.

In the event that such curb, gutter or sidewalk is constructed within ninety days from the time the grade is established then such deposit shall be refunded; otherwise it shall be retained by the Village as liquidated damages to defray the expenses of establishing such grade.
