16.25.050: APPEAL TO CITY COUNCIL:
   A.   An affected person may request an appeal of the Planning Commission's decision by filing a written request for appeal with the Planning Director within fifteen (15) days after the decision by the Planning Commission. The appeal must be accompanied by the fee established by the City Council. Upon receipt of an appeal, the Planning Director will notify the City Clerk, so that a time and place may be set for a public hearing by the City Council.
   B.   The City Council will, after notice as prescribed in subsection 17.09.120B of this Code, hold a de novo public hearing on the proposal. The City Council may approve, conditionally approve, deny or deny the request without prejudice. Alternatively, the City Council may defer action on the request until the next scheduled hearing in order to review additional information that it deems necessary in order to render a final decision. In order to approve a preliminary plat request the City Council must make the findings contained in section 16.25.030 of this chapter.
   C.   A copy of the City Council's final decision shall be mailed to the applicant and the Clerk shall make the decision available for public inspection. (Ord. 3674 §2, 2021: Ord. 3600, 2018: Ord. 3485, 2014)
