10.70.040: STANDARDS FOR ISSUANCE:
   A.   Only one permit will be granted for the same time and/or location. The city clerk shall issue a permit on a first come, first served basis.
   B.   The city clerk and the chief of police may request such information from the applicant as is necessary in their sole discretion to determine whether to approve the application. The information may be requested in the permit application form, through written instructions available from the city clerk or the chief of police, or through written or oral inquiries addressed to the applicant. The time for considering the permit shall be extended by the time taken by the applicant in responding satisfactorily to any inquiry.
   C.   There shall be no discrimination in granting, denying, or conditionally granting permits under this chapter based upon the content of the applicant's message or political, religious, ethnic, racial, disability, or gender related grounds.
   D.   The city clerk may deny a permit if the applicant or the person who is representing the applicant has on prior occasions made material misrepresentations regarding the nature or scope of a solicitation for contribution event previously permitted or has violated the terms of prior permits issued to; or if the applicant or the persons acting on behalf of the applicant have on prior occasions damaged city property and not paid in full for such damage or has other unpaid debts to the city clerk.
   E.   A permit may be denied where the city clerk, upon the advice of the chief of police, determines that the standing on the highway for solicitation of contributions unreasonably disrupts traffic or public services. Standing on a highway for solicitations of contributions may be halted by the chief of police if at any time participants fail to conform to the permit.
   F.   No permit shall be issued more than one year prior to the date of the permitted activity.
   G.   The applicant shall provide to the city a hold harmless agreement from each participant holding the city harmless from any injury the participant might sustain as the result of participation in the solicitation activity. (Ord. 3023 §4, 2001, eff. 7-1-2001)
