It is made the duty of the city clerk to serve a notice in writing upon the owner and occupant of any real property within the corporate limits of the city on which there is being erected, constructed or maintained unauthorized barbed or electrified wire fence or gate made of barbed or electrified wire as prohibited in section 8.16.010 of this chapter, if both owner or occupant live and reside and are in the city, but if the owner of the real property on which such barbed or electrified wire fence or gate made of barbed or electrified wire is situated is not in the city, then the written notice shall be served only on the occupant or any party having control or management of such premises upon which any such barbed or electrified wire fence or gate made of barbed or electrified wire is being erected, constructed or maintained, and the notice shall state that such owner, or occupant or party having the control or management of such property shall within ten (10) days from the date of service of the notice upon him, remove or cause to be removed such barbed or electrified wire fence or gate made of barbed or electrified wire.
