5.12.060: RESTRICTIONS ON SALE; RETAIL LICENSES:
Retailers holding valid licenses for the retail sale of liquor by the drink, pursuant to chapter 9, title 23 of the Idaho Code may sell wine for consumption on or off the licensed premises. Retailers who do not possess a valid license for the retail sale of liquor by the drink, or the sale of wine by the drink, shall not permit consumption of wine on the licensed premises and may sell the wine only in its original unbroken container. Wine by the drink, sold by licensed retailers holding a valid liquor by the drink license, may be sold only during hours that liquor by the drink can be sold pursuant to the laws of this State. Wine sold by licensed retailers, for consumption off the premises, may be sold only during the hours that beer may be sold pursuant to the laws of this State. Retailers holding a valid wine by the drink license may sell wine for consumption on the premises only. Retailers licensed to sell wine by the drink, but not licensed to sell liquor by the drink, may sell wine by the drink only during the hours that beer may be sold pursuant to the laws of the State.
