A. All applications for a permit under this chapter must be filed with the City Clerk's Office on a form provided by the City Clerk's Office, verified by the applicant and accompanied by the filing fee, no less than five (5) business days prior to the proposed use.
B. The application must state:
1. The name and address of the applicant;
2. The dates and hours proposed;
3. The names of the organizations, groups, or persons sponsoring the use;
4. The location of the use;
5. The number of participants expected; and
6. A description of the use.
C. The City Clerk shall issue the permit on a first come, first served basis, and shall not discriminate against any person or group, but may deny an application based on conflicting use or the need to protect the public or property.
D. An applicant may appeal the denial of a permit to the designated Appeal Hearing Officer. An appeal must be filed in writing with the City Clerk within forty eight (48) hours, excluding weekends and holidays, after receipt of the notice of denial. The Hearing Officer shall make a written decision prior to the planned date of the proposed use, or within seven (7) business days of the appeal, whichever is earlier.
