705.02 LICENSE REQUIRED.
   (a)    Any person applying for a license shall pay the City Manager a fee of ten dollars ($10.00) each time the show, entertainment or theater performance is intended to be given, provided that:
      (1)    Where the owner, manager or exhibitor of such show intends to show, exhibit or perform or intends such show, exhibition, concert or theater to show, exhibit, entertain or perform more than one day, the City Manager is hereby authorized to grant a license for a definite period to be named therein, and shall charge a fee of twenty-five dollars ($25.00) per diem;
      (2)    This section shall not apply to any show, entertainment, concert, exhibition or theater performance given or conducted for the benefit of any local religious, charitable, literary, educational or public institution, organization or purpose.
   (b)    Council may by resolution fix the amount to be paid for a yearly license to any proprietor of any public opera house, theater building or hall, safely equipped and kept for the accommodation of shows, entertainments, exhibitions or theaters. Such license shall authorize the opera house, theater building or hall to be used as place of public entertainment, and shall allow the proprietor the privilege of exhibiting, enacting or performing or permitting others in such opera house, theater building or hall, to exhibit, enact or perform any show, entertainment, concert or theater, not prohibited by any State law or City ordinance.
   (c)    Upon passage of the resolution specified in subsection (b) hereof, the Clerk shall, upon receipt of the amount of the yearly license, issue to the proprietor a certificate authorizing the use of such opera house, theater or hall. Such license shall expire on December 31 of the year when issued.
   (d)    No license issued under this section shall be transferable.
