(a) The Police Chief, or any police officer, shall inspect each bicycle presented to him for licensing and shall have the authority to refuse to approve the application for a license for any bicycle found to be in an unsafe mechanical condition.
(b) The Police Chief is authorized to call for inspection of all bicycles on such dates as he may set, not to exceed twice in one year, when all owners or operators shall bring in their bicycles to such places as the Police Chief may designate for the purpose of such inspection.
(c) The Police Chief is authorized to deputize any person or persons who are residents of the City to aid him in the enforcement of this chapter. Such deputies shall serve without pay. (Ord. 1969-33. Passed 11-25-69.)
(d) Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
