(a) The Department of Environmental Services shall become part of and fall under the Department of Service and Safety.
(b) The Existing employees of the collection and distribution section shall become employees of the Department of Environmental Services. All employees shall be certified by the State of Ohio, and licensed by Ohio Environmental Protection Agency (OEPA) in water distribution or wastewater collection or both, except for those employees classified as equipment operators.
(c) The manning strength of the Department of Environmental Services shall be as follows: one superintendent; one foreman; three water/wastewater technicians; one equipment operator and two meter readers. The compensation for the above positions, except the superintendent, shall be the same as indicated in the collective bargaining agreement
(d) New employees, except the superintendent, shall be by civil service testing. Newly hired employees shall become certified and licensed in either water distribution or wastewater collection within three years from date of hire. Employees who fail to become certified in either discipline within the three years shall have their employment severed with the City.
(e) The Department of Environmental Services shall be headed by the superintendent of said department. The superintendent will be responsible for the development of the departmental annual budget; exercise control over its operations and equipment, including planning and daily supervision of employees under his control. He shall be responsible for any and all reports that may be required by Ohio Environmental Protection Agency (OEPA) relative to the collection and distribution systems of the City. The superintendent will also maintain accurate and updated city mapping, including computerized modeling of both systems. Due to the nature of the departments' mission, the superintendents of both water and wastewater shall act as liaisons to the department of Environmental Services.
(f) The department shall be responsible for the maintenance and repair of all water distribution systems under control of the City, including backflow prevention and cross contamination. The department will install or caused to be installed all new water lines; perform construction observation and construction management and perform final inspections when said lines are installed by persons other than City personnel.
(g) The department shall be responsible for the installation, maintenance and repair of all combined sanitary sewer systems and sanitary sewers, including all sanitary wet wells and lift stations. The department shall act as construction observation; construction management and perform final inspections of all sanitary sewer lines installed by persons other than City personnel.

(h) The annual budget for the Department of Environmental Services shall be derived from the revenues collected from the Water Fund and Sewer Fund and charged back to the Water Fund based on sixty-five percent (65%) of the actual monthly costs of the Department and charged back to the Sewer Fund based on thirty-five percent (35%) of the actual monthly costs of the Department. The Finance Director shall review the actual hours of work performed by Environmental Services in the Sewer Fund and Water Fund to ensure that these percentages are still proportional. The Finance Director shall make adjustments to these percentages on an annual basis, if needed without further consent by this Council.
