139.02 FIRE DEPARTMENT.
   (a)   Organization. The organization of the Fire Department shall be as provided herein:
      (1)   There shall be two Chief Officers for every three active pumpers or fraction thereof, one of whom shall be the Chief of the Fire Department and the other an Assistant Chief.
      (2)   There shall be two company officers for each active truck, who shall be either captains or lieutenants.
      (3)   There shall be two operators for each pumper in service.
      (4)   There may be two instructors for firemen training who shall be certified by the State of Ohio, Department of Education, Ohio Division of Vocational Trade and Industrial School.

      (5)   There shall be one Chief Engineer and at least one Assistant Engineer who may be an operator, who shall be responsible for the maintenance of all fire equipment. Both shall be classified as officers.
      (6)   There shall be one Secretary-Treasurer and one Paymaster either of whom may be any member of the Fire Department. The Secretary-Treasurer shall be responsible for all records of the Department and the Paymaster shall bear responsibility for payrolls.
      (7)   The total number of members of the Fire Department shall be determined by the average response to fires and must be sufficient to meet the standards of the Ohio Inspection Bureau. The City Manager, upon advice from the Fire Chief, shall review and establish the number of members from time to time. (ORd. 2002-08. Passed 2-1-00.)
   (b)   Appointments, Promotions, Disciplinary Procedure.
      (1)   The Fire Chief shall be appointed by the City Manager.
      (2)   The Fire Department shall have two assistant Fire Chiefs. The appointment of Assistant Fire Chiefs shall be made by the City Manager. Each Assistant Fire Chief shall be assigned to either the Main Fire Station or the McPherson Highway Fire Station by the Fire Chief. Assistant Fire Chiefs shall be responsible for the daily operation and maintenance of each facility, including all equipment. Assistant Fire Chiefs shall have a minimum of five years (5) experience in the Clyde Fire Department, including at least one year (1) as a Company Officer or Engineer within the department.
      (3)   All Company Officers shall be appointed by the City Manager. All Company Officers shall have had a minimum of five years (5) experience in the Clyde Fire Department and hold a valid trade and Industrial Education Card. Applicants for the position of Captain will have had a minimum of one year (1) of service as either a Lieutenant or Engineer within the department. All Company Officers appointed by the City Manager shall continue to serve in that position, unless promoted or removed for just cause.
      (4)   The position of Operator, Training Officer, Engineer, Secretary and Paymaster shall be appointed on an annual basis.
      (5)   New members shall be appointed by the City Manager. New members shall be between the ages of eighteen (18) and thirty-five (35) at time of appointment. Exception on age will be case by case as long as the new member holds a valid firefighter certification and is recommended by the Fire Chief, and approved by the City Manager. Each new member shall have passed a physical examination prior to appointment. Costs associated with a physical examination shall be paid for by the City. New members shall serve a one (1) year probationary period before receiving permanent appointment within the department. All new members shall obtain a valid Trade and Industrial Education Card prior to permanent appointment. Prior to obtaining such Trade and Industrial Education card, the new member shall not be actively involved in the actual fighting of fires.
      (6)   No member of the Clyde Fire Department shall be removed from their position without a pre-disciplinary hearing. The Fire Department shall follow the established procedure within the City of Clyde Personnel Policy on all matters relative to discipline.

   (c)   Rules and Regulations. The Fire Chief and company officers shall prepare a set of rules and regulations for the operation and organization of the Fire Department in consultation with the Department members. These rules shall be adopted by a majority vote of the members of the Department and shall be effective upon approval of the City Manager. The Fire Chief shall decide all cases involving violations of these rules and may reprimand, suspend up to three months or dismiss any member for violation thereof.
   (d)   Number of Department Meetings. The Manager, upon recommendations of the Fire Chief, shall establish the number and frequency of Department meetings.
