1165.02 MULTIPLE-FAMILY RESIDENTIAL DEVELOPMENT APPROVAL PROCESS.
   (a)    The Multiple-Family Residential Development approval process shall consist of the following steps:
      (1)    Submission of the completed application, material and fees to the office of the City Manager;
      (2)    Approval by the Planning Commission of the proposed development; and
(3)    Issuance of zoning certificates in compliance with the approved development.
   (b)    Applications for approval of a Multiple-Family Residential Development may be obtained from the office of the City Manager and when completed three copies shall be returned to that office.
   (c)    If the proposed development does not involve the extension or widening of any public street or the extension of any public sewer, water or other public facility, the application shall consist of the application form, the required fees and the following additional items:
      (1)    A base map presenting:
         A.    Boundaries of the tract to be developed;
         B.    The existing topography, drainageways, water bodies and trees over six inches in diameter;
         C.    Highways and streets in the vicinity of the tract, the ingress and egress to the tract, and the relationship of the development to existing traffic patterns;
         D.    Existing sanitary and storm sewer and water systems on the tract and in the vicinity;
         E.    The proposed treatment of topography, drainageways, water bodies and trees over six inches in diameter;
         F.    The proposed location and size of water, sanitary and storm sewer systems;
         G.    The proposed circulation system within the tract to be developed; including the off-street parking and loading areas;
         H.    The proposed location and type of units to be developed;
         I.    The location of proposed open space and recreation areas;
         J.    The proposed landscaping; and
         K.    The proposed outdoor lighting.
(2)    Plans for the type of buildings to be constructed within the development including elevations and floor plans;
(3)    For condominium development, copies of the declaration and other requirements of Ohio R.C. Chapter 5311 for Condominium Developments;
(4)    Copies of the Homeowners Association Agreement, if appropriate;
(5)    A time schedule of the projected development if the proposal is to be developed in stages or if the construction is likely to extend beyond a two-year period.
(6)    Any other material required by the Planning Commission.
   (d)    If the proposed development involves the extension or widening of any public street or the extension of any public sewer, water or other public facility, the Planning Commission shall follow the Procedure for Plat Approval (found in Chapter 1105 and its amendments) except that the process shall be completed within sixty days unless a longer period is agreed to by the applicant. In addition to the application materials required by Chapter 1105, the following material shall also be provided:
      (1)    Plans for the type of buildings to be constructed within the development including elevations and floor plans;
      (2)    For condominium development, copies of the declaration and other requirements of Ohio R.C. Chapter 5311 for Condominium Developments;
      (3)    Copies of the Homeowners Association Agreement, if appropriate;
      (4)    A time schedule of the projected development if the proposal is to be developed in stages or if the construction is likely to extend beyond a two-year period;
      (5)    Any other material required by the Planning Commission.
   (e)    If the proposed development is included within a Planned Unit Development (PUD), the requirements of this chapter shall not apply. The Multi-Family Residential Development shall be approved as part of the PUD.
   (f)    Within three working days after the filing of the application, it shall be transmitted to the Planning Commission.
   (g)    The Planning Commission shall approve, approve with modifications, or deny the application within sixty days after the application has been submitted.
   (h)    The Planning Commission shall approve the application if:
      (1)    All requirements of the application process are met;
      (2)    All the design standards of Chapters 1109 and 1113 and their amendments are met;
      (3)    All zoning requirements of Chapter 1145, 1149, 1153, 1157 and other appropriate chapters are met; and
(4)    Other requirements imposed by the Planning Commission for the promotion of the public health, safety and general welfare are met.
   
   (i)    Approval through subsection (d) as outlined herein, shall also be considered as Final Plat approval.
   (j)    Zoning certificates shall be issued by the City Manager and shall be required for each structure. The certificates shall be issued only in compliance with the approved application.
