925.01 DEFINITIONS.
   As used in this chapter:
    (a)   "Sewage works" means Publicly Owned Treatment Works (POTW) and all facilities for collecting, pumping, treating and disposing of sewage.
    (b)   "City Manager" or "Manager" means the City Manager of the City of Clyde, Ohio or his authorized deputy, agent or representative.
   (c)   "Public sewer" means a sewer in which all owners or abutting properties have equal rights and which is controlled by public authority.
   (d)   "Combined sewer" means a sewer receiving both surface runoff and sewage.
   (e)   "Sanitary sewer" means a sewer which carries sewage and wastes and to which storm, surface, and ground waters are not intentionally admitted.
   (f)   "Storm sewer" or "storm drain" means a sewer which carries storm and surface waters and drainage, but does not carry sewage and polluted industrial wastes.
   (g)   "Sewage treatment plant" or "water pollution control plant" means any arrangement of devices and structures used for treating sewage.
   (h)   "Garbage" means solid wastes from the preparation, cooking and dispensing of food and from the handling, storage, and sale of produce.
   (i)   "Properly shredded garbage" means the wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half inch in any dimension.
   (j)   "Building drain" means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste, and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet outside the inner face of the building wall.
   (k)   "Building sewer" means the extension from the building drain to the public sewer or other place of disposal.
   (l)   "pH" means the logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution and indicating the acid or basis character of any solution.
   (m)   "Suspended solids" means solids that either float on the surface of, or are in suspension in, water, sewage, or other liquids and which are removable by laboratory filtering.
   (n)   "Natural outlet" means any outlet into a watercourse, pond, ditch, lake or other body of surface or ground water.
   (o)   "Watercourse" means a channel in which a flow of water occurs, either continuously or intermittently.
   (p)   "Person" means any individual, firm, company, association, society, corporation, or group.
   (q)   The word "shall" is mandatory; "may" is permissive.
   (r)   "City" see Authority.
   (s)   "City Engineer" means the City Engineer of the City.
   (t)   "Plumbing Inspector" means the Plumbing Inspector of the City as appointed by the City Manager.
   (u)   "Act" means The Clean Water Act (33 U.S.C. 1251 et. seq.), as amended.
   (v)   "Authority" means the City of Clyde, Ohio, acting through its duly authorized officials and employees.
   (w)   "Pretreatment" means the reduction of the amount of pollutants, the elimination of pollutants, or the alteration of the nature of pollutant properties in wastewater to a less harmful state prior to or in lieu of discharge or otherwise introducing such pollutants into a POTW.
   (x)   "National Categorical Pretreatment Standards" means National Pretreatment Standards specifying quantities or concentrations of pollutants or pollutant properties which may be discharged or introduced into a POTW by specific Industrial Dischargers.
    (y)   "Industrial Discharger" means a source of Indirect Discharge or Discharge of pollutants into a POTW from any non-domestic source regulated under Section307 (b), (c) or (d) of the Act.
    (z)   "Other wastes" means decayed wood, sawdust, shavings, bark, lime, refuse, ashes, garbage, offal, oil, tar, chemicals, and all other substances except sewage and industrial wastes.
   (aa)   "Sewage" means water-carried human wastes or a combination of water-carried wastes from residence, business buildings, institutions and industrial establishments, together with such ground, surface, storm or other waters as may be present or permitted or authorized by a permit issued by the City Manager.
   (bb)   "Industrial waste" means solid, liquid or gaseous waste resulting from any industrial, manufacturing, trade, or business process or from the development, recovery, or processing of natural resources.
   (cc)   "O and M" means Operation and Maintenance.
   (dd)   "POTW" means any sewage treatment works and the sewers and conveyance appurtenances discharging thereto, owned and operated by the Authority.
   (ee)   "Wastewater" means industrial waste, or sewage or other waste including that which may be combined with any groundwater, surface water, or storm water, that may be discharged to the POTW.
   (ff)   "NPDES" means National Pollutant Discharge Elimination System permit program as administered by the Ohio Environmental Protection Agency.
   (gg)   "Interference" means a Discharge, which, alone or in conjunction with a discharge or discharges from other sources, both: (1) Inhibits or disrupts the POTW, its treatment processes or operations, or its sludge processes, use or disposal; and (2) Therefore is a cause of a violation of any requirement of the POTW's NPDES permit (including an increase in the magnitude or duration of a violation) or of the prevention of sewage sludge use or disposal in compliance with the following statutory provisions and regulations or permits issued thereunder (or more stringent State or local regulations); Section 405 of the Clean Water Act, the Solid Waste Disposal Act (SWDA) (including Title II, more commonly referred to as the Resource Conservation and Recovery Act (RCRA), and including State regulations contained in any State sludge management plan prepared pursuant to Subtitle D of the SWDA), the Clean Air Act, the Toxic Substances Control Act, and the Marine Protection, Research and Sanctuaries Act.
   (hh)   "Sewer" means any pipe, conduit, ditch, or other device used to collect and transport sewage or storm water from the generating source.
   (ii)   "New Source" means any building, structure, facility or installation from which there is or may be a discharge of pollutants, the construction of which commenced after the publication of proposed Pretreatment Standards under Section307(C) of the Act which will be applicable to such source if such standards are thereafter promulgated in accordance with that section. This source may be at a new site, total replacement of a previous process or production equipment at an existing source, or new wastewater generation processes independent of an existing source at the same site.
   (jj)   "Slugload" means any pollutant, including oxygen demanding pollutants (BOD, etc.) released in a single extraordinary discharge episode of such volume or strength as to cause interference to the POTW.
   (kk)   "Pass Through" means a Discharge which exits the POTW into waters of the United States in quantities or concentrations which, along or in conjunction with a discharge or discharges from other sources, is a cause of a violation of any requirement of the POTW's NPDES permit (including an increase in the magnitude or duration of a violation).
   (ll)   "Significant Industrial User" means (a) Except as provided in part (b) of this section, the term Significant Industrial User includes: (i) All industrial users subject to categorical pretreatment standards; and (ii) Any other industrial user that: discharges an average of 25,000 gallons per day or more of process wastewater to the POTW; contributes a process wastestream which makes up 5 percent or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant; or has a reasonable potential in the opinion of the Director, to adversely affect the POTW's operation or for violating any pretreatment standard or requirement. (b) The Director may at anytime, on its own initiative or in response to a petition received from an industrial user, determine that a noncategorical industrial user is not a Significant Industrial User if the industrial user has no reasonable potential to adversely affect the POTW's operation or for violating any pretreatment standard or requirement.
   (mm)   "Interceptor sewers" means those sections of the public sewer which intercept sewage and wastes from trunk sewers and transport such sewage and wastes to the wastewater treatment plant.
   (nn)   "Lateral or local sewers" means those sections of the public sewer, eight inches in size and providing service for local service or individual streets only, designed and constructed to-collect sewage and wastes from service sewers and transport such sewage and Wastes to the trunk or sub-trunk sewers.
   (oo)   "Permit" means 'the permission by the City for residences, apartments, hotels, motels, business buildings or properties, institutions and industrial establishments to connect to a public sewer of the City.
   (pp)   "Sanitary sewage" means sewage discharged from residences, apartments, hotels, motels, business buildings or properties, institutions and industrial establishments, and free from storm, surface water and industrial wastes.
   (qq)   "Service sewers" means those sections of the public sewer and any private sewers, which collect sewage and wastes from residences, apartments, hotels, motels, business buildings or properties, institutions and industrial establishments, and transport such sewage and wastes to the lateral or local sewers.
   (rr)   "Sewer connection" means the Y-branch or sewer stack device used for making the connection of service sewers to the public sewer.
   (ss)   "Sewerage system" means all facilities of the City for collecting, pumping, treating and disposing of sewage.
   (tt)   "Tap-in" means the connection of any private service sewer to the public sewer.
   (uu)   "Tap-in charge" means the charge to be collected by the City for a connection to the public sewer.
   (vv)   "Trunk or sub-trunk sewers" means those sections of the public sewer which collect sewage and wastes from lateral or local sewers and transport such sewage and wastes to the interceptor sewers.
   (ww)   "Wastewater treatment facilities" means those structures, equipment, machinery and devices used for treating sewage.
