Written commitments may be enforced jointly and severally by:
(A) The town’s Plan Commission;
(B) The town’s Board of Zoning Appeals; and
(C) Owners of all parcels of ground adjoining the real estate involved in the relevant commitment to a depth of 300 feet. The identity of such owners shall be determined from the records of the office of the County Auditor which lists the current owners of record. For purposes of this division (C), the cutoff date for such determination shall be at 12:00 p.m. on the date of filing for enforcement.
