11-4-14: SUBDIVISION ASSOCIATIONS:
   A.   Formation: A subdivision association may be formed to perform services for the development as a whole, per the requirements of the code of Iowa, chapter 504.
   B.   Registration: All subdivision associations within the city shall register on forms provided by the community development department.
   C.   Covenants; Requirements Of Association:
      1.   In accordance with covenants formed by such associations, provisions shall provide for the maintenance of uses and structures including, but not limited to:
         a.   Walls and fences;
         b.   Structures such as gatehouses and decorative fountains;
         c.   Directional signs and signs identifying the development, provided such signs conform to provisions outlined in chapter 12, “Signs”, of this title;
         d.   Monuments;
         e.   Underground irrigation;
         f.   Hedges, shrubs and trees;
         g.   Berms and buffers;
         h.   Private streets; and private utilities;
         i.   Stormwater management facilities.
      2.   If any structure or use outlined above becomes in a state of disrepair as determined by the city, the city may require improvement of the condition of the structure or use. If the structure or use is not improved, then such use shall be construed as a site plan violation and enforced as such.
   D.   Responsibilities: Provisions set forth in the covenant shall become the responsibility of the subdivision association when 70% of the lots are developed, unless otherwise stated in the agreement. (Ord. 1098, 1-28-2021)
