Users shall inform the WRA Director within one hour of becoming aware of an upset in operations that places it in a temporary state of noncompliance with the pollutant limits in this chapter. Users shall provide a follow-up written report to the WRA Director within five (5) days. The report must demonstrate that the pretreatment facility was being operated in a prudent and appropriate manner and shall contain:
A. A description of the upset, its cause, and impact on the user's compliance status.
B. The duration of noncompliance, including exact dates and times of noncompliance, and, if the noncompliance is continuing, the time by which compliance is reasonably expected to be restored.
C. All steps taken or planned to reduce, eliminate, and prevent recurrence of such an upset. (Ord. 1069, 3-14-2019)
