5-11-1: PURPOSE:
   A.   The City Council does hereby find that:
      1.   It is the intent of the City Council by enacting this chapter to recognize free speech rights for all citizens while at the same time ensuring the safety of all citizens on and along the public roadways within the City,
      2.   However, the City Council finds that certain types of actions directed at users of the public roadways in Clive and conducted in specific areas within the City pose an increased safety risk for pedestrians and users of public roadways within the City, and
      3.   The City Council finds that the presence of solicitors in certain specific areas creates increased safety risks to pedestrians and users of public roadways within the City, and
      4.   The City Council further finds that certain forms of solicitation impede the orderly flow of pedestrian and vehicular traffic along and on the public roadways within the City, and
      5.   This chapter is not intended to impermissibly limit an individual's right to exercise free speech with solicitation; rather it aims to impose specific time, place, and manner restrictions on solicitation and associated conduct in certain limited circumstances and in certain locations, and
      6.   In promulgating this chapter, the City Council seeks to impose regulations that are narrowly tailored to serve the aforementioned significant government interests. (Ord. 1066, 1-10-2019)
