5-7-16: IMPOUNDMENT, REDEMPTION AND DISPOSITION OF ANIMALS:
   A.   Contract for Impounding: The City may enter into a contract with any health department or any public or private agency or organization for the use of its facilities for the restraining and impounding of dogs, cats, or other animals, for assisting in the collection of unlicensed dogs and cats, and for the destruction or disposition of such animals as provided by ordinance or law. All animals so impounded shall be given humane care. (2000 Code § 55.17)
   B.   Notice of Impounding: It is the agreed duty of the contractor to give notice to the owner of any animal impounded if such owner's name and address appear on the animal's collar or if such owner is otherwise known. (2000 Code § 55.18)
   C.   Access to Records: It is agreed the City of Clive shall grant access to the contractors, to records of ownership and pet licensing for the limited purpose of and in an effort to increase the opportunity of locating the owner of an animal impounded to the contractor's facility.    D.   Period for Keeping Dogs And Cats: All dogs and cats impounded that do not have a current license, collar or similar identification shall be kept for not less than four (4) days after being impounded, unless sooner redeemed by the owner in accordance with this chapter. All dogs and cats impounded that have a current license, collar or similar identification shall be kept for not less than six (6) days after being impounded, unless sooner redeemed by the owner in accordance with this chapter.    E.   Redemption Of Animals: The owner of any dog, cat, or other animal shall pay impoundment, pick up, and disposal fees to the contractor. The amounts of the fees shall be established by resolution approved by the City Council. (Ord. 957, 1-19-2012)
   F.   Disposition of Animals:
      (1)   After the fifth (5th) day of impoundment, an unclaimed and unlicensed dog, cat or other animal, not held for observation, may be humanely destroyed or adopted to a new owner by the contractor at their discretion.
      (2)   After the seventh (7th) day of impoundment, of a licensed animal where ownership has been identified, an unclaimed but licensed dog, licensed cat or other animal, if not being held for observation, at the discretion of the contractor, may be humanely destroyed, or adopted to a new owner. (2000 Code § 55.22)
      (3)   At the expiration of the observation period, an unredeemed dog, cat or other animal being held for observation, at the discretion of the contractor, may be humanely destroyed or may be adopted to a new owner.
      (4)   The City of Clive agrees to take part in a Trap Neuter/Spay Release (TNR) program for community cats. Community cats impounded under the TNR program, will be neutered or spayed while in the care of the contractor, have their ears clipped, and be returned to the wild, where they were located.
