5-7-1: DEFINITIONS:
The following terms are defined for use in this chapter:
   ANIMAL: Every wild, tame or domestic member of the animal kingdom other than a human vertebrate.
   ANIMAL SHELTER: Any premises, either designated, or contracted for the proper care of impounded animals held under the authority of this chapter.
   AT LARGE: Found within the City upon any street, alley, sidewalk, public or private grounds. A dog, properly licensed as required by law, is not deemed to be at large if:
      A.   It is on the premises of the owner; or
      B.   It is under the control of a person competent to restrain and control the dog, either by leash, cord, chain or other similar restraint or properly restrained within a motor vehicle; or
      C.   It is properly housed in a veterinary hospital or kennel; or
      D.   It is accompanied by or at "heel" beside and obedient to the commands of the owner or a competent responsible person.
   Notwithstanding any other provision of this chapter, any dog is deemed at large at any time when attacking persons or domestic animals, destroying property, or on a public school ground except when under restraint as set out in Subsections B and D of this definition. Further, any female dog in heat is deemed at large at any time when not under restraint as set out in Subsections A and C of this definition.
   CAT: All members of the Felis domestica species, male or female, altered or unaltered.
   COMMUNITY CAT: Any member of the Felis domestica species, male or female, altered or unaltered, that primarily lives as a wild cat in the City of Clive, where no ownership can be determined.
   CONTRACTOR: The third-party engaged by approval of the City Council to provide pet licensing, animal control, transport and/or sheltering services.
   DOG: All animals of the canine species, male and female, altered and unaltered.
   KENNEL: Any business premises on which four (4) or more dogs, or four (4) or more cats, six (6) months old or older, are kept or raised solely for the bona fide purpose of sale and which are kept under constant restraint.
   LICENSED CAT: Any cat bearing a currently valid license under Section 5-7-2 of this chapter.
   LICENSED DOG: Any dog bearing a currently valid license under Section 5-7-2 of this chapter.
   LIVESTOCK: An animal belonging to the bovine, caprine, equine, ovine or porcine species; farm deer, as defined in Section 481A.1 of the Code of Iowa; ostriches, rheas, emus or poultry.
   OWNER: Any person owning, keeping, sheltering or harboring an animal.
   PET SHOP: Any person engaged in the business of breeding, buying, selling or boarding animals of any species, except the operation of a kennel, agricultural or wildlife pursuits. (2000 Code § 55.01)
   TRAP NUTER/SPAY RELEASE (TNR): A program administered by a third-party contractor to identify community cats, provide means to alter those animals and return them to the area they were found in.
