4-6-7: CLEANING YARD:
The permittee shall cause the Christmas tree sales yard to be cleaned and cleared of all materials constituting a public nuisance, Christmas trees, and temporary shelters prior to January 1 of the year next following the issuance of the permit. In the event the Christmas tree sales yard is not so cleaned and cleared, the city clerk's office shall cash the deposit check and deposit the proceeds in the city's general fund. The city clerk shall then notify the director of public works to cause the yard to be cleaned and to have removed all materials therefrom which constitute a public nuisance, including Christmas trees, debris and temporary shelters. The proceeds of the deposit shall be used to reimburse the appropriate city fund for the cost of such removal and cleaning. (2000 Code § 125.07; amd. 2008 Code)
