§ 95.08 DOGS CAPTURED.
   (A)    Any dog that is permitted to run unrestrained will be captured by the city. The dog will be held by the city for a period of 72 hours. The owner shall be responsible to pay the city a fee of $30 if the dog is reclaimed from the city. Fees received shall be deposited in the city’s Bark Park Fund.
   (B)   If the dog has not been claimed during that period of time and the owner cannot be determined by identification tags on the animal, the dog will be taken to the Parke Vermillion County Humane Society. The owner shall be responsible for any fees assessed by the Parke Vermillion County Humane Society.
   (C)   The owner of any dog captured and held by the city must first show proof of vaccination for the dog prior to release.
   (D)   Each 24 hours that a violation occurs will be considered a separate offense and can be cited as such. The owner shall be assessed a fine of $25 for a first offense, $50 for a second offense, and $250 for a third and any subsequent offenses.
   (E)   After one citation of this chapter for an animal running at large, any unaltered animal(s) must be spayed or neutered at the owner's expense.
