10-3-5: SANITARY SEWER:
   (A)   All multi-family, commercial and industrial developments shall be connected to a public sanitary sewer system or private treatment facility provided by the owner, meeting the approval and requirements of the city of Clinton, state of Illinois, department of health and environmental protection agency.
   (B)   The minimum size of pipe for sanitary sewer main extensions shall be eight inches (8"). The minimum size of pipe for sanitary service sewers (from sewer main to building) shall be six inches (6").
   (C)   Sanitary sewer sizes shall be increased in cases where the flow from a proposed development exceeds the capacity of the above mentioned minimum sizes.
   (D)   If the city desires to increase the size or capacity of any portion or all of the sanitary sewer proposed by the owner in order to provide service to areas not located within or beyond the limits of said development, the cost thereof in excess of the cost of the owner's proposed installation shall be refunded by the city to the owner on the following basis:
      1.   Prior to construction, the owner and the city shall agree upon the location and acreage of the land which the excess capacity is designed to serve, and shall agree on the total excess cost in dollars.
      2.   Any subdivider, developer or property owner in the area as established according to this subsection (D), for which the said excess capacity has been provided, shall pay to the city the dollar cost of such excess capacity in the same proportion that the acreage for which the excess capacity was provided; whereupon the city shall refund a like amount to the owner providing said excess capacity.
   (E)   Sanitary sewers shall be constructed in accordance with the "Standard Specifications For Water And Sewer Main Construction In Illinois" and requirements of the environmental protection agency.
   (F)   The owner shall be responsible for obtaining the required permits for the installation and operation of sewers prior to start of construction.
   (G)   The owner shall pay reasonable tap-on or connection charges, the same being determined by resolution duly adopted by the city council of the city from time to time.
   (H)   All sanitary sewers shall be tested and shall meet the requirements for allowable leakage, as required by the "Standard Specifications For Water And Sewer Main Construction In Illinois". Test results properly certified by the owner's engineer, shall be submitted to the city prior to final acceptance of the sanitary sewer improvements, by the city. (Ord. 868, 11-19-2001)
