10-1-3: APPROVAL AND EXCEPTIONS:
   (A)   No lot, block, parcel or tract of land shall, after adoption of this title, be developed for multi-family, commercial or industrial use, nor any improvements made to the land, until all requirements of this title, the requirements of the city zoning regulations, and approval and issuance of the building permit is granted by the city.
   (B)   No lot, block, parcel or tract of land will be approved for multi-family, commercial or industrial development which is subject to periodic flooding or which contains poor drainage facilities, and which would make adequate drainage of the area to be developed, impossible.
   (C)   Severe flooding experienced along the major watercourses and their tributaries in and adjacent to the city makes it essential that special attention be directed to title 12, chapter 4, article L, "O-FP Floodplain Overlay District", and also title 12, chapter 15, "Special Flood Hazard Areas", of this code.
   (D)   Filling in or reducing the volume of water storage of a floodplain below the high water elevation for a 100-year storm or other higher elevation that may be established by the city, shall not be approved. Both upstream and downstream properties shall be protected from increased flood hazard.
   (E)   All land offered to the city for use as streets, alleys, schools, parks and other public use, shall be referred to the plan commission for review and recommendation before being accepted by the city council, or by any other governing authority of the city.
   (F)   In all site development, due regard shall be given to the preservation of historical sites and natural features such as large trees, watercourses and scenic views.
   (G)   The city council may vary and make exceptions, as set forth herein, in instances where there is sufficient evidence, in its opinion, of hardship caused by topographic conditions, or where any other reasonable deterrents prevail. (Ord. 868, 11-19-2001)
