3-3-26: SALE OF ALCOHOLIC LIQUOR AT RETAIL OUTSIDE LICENSED IMPROVEMENTS:
A licensee may sell alcoholic liquor at retail in an area outside of the building or other structure where the sale of alcoholic liquor is permitted provided:
   (A)   Licensee with sidewalk cafe permit: The licensee has a valid sidewalk cafe permit and the sale of alcoholic liquor is limited to the sidewalk cafe permit area.
   (B)   Licensee without sidewalk cafe permit:
      1.   The permanent outside service area shall be contiguous to the building or other structure where the sale of alcoholic liquor is permitted, shall contain a seating capacity that is not greater than the seating capacity of the building or other structure where the sale of alcoholic liquor is permitted, and shall extend only to the public right of way line.
      2.   The permanent outside service area shall be screened or fenced in such a manner that access to and egress from such outside area, except for fire and other emergency purposes, shall only be through the building or other structure where the sale of alcoholic liquor is permitted.
Any licensee desiring to provide outside service shall submit the plans and specifications therefor to the local liquor control commissioner who may impose such conditions as are reasonable and proper under the circumstances in connection with the issuance of permission to sell alcoholic liquor at retail in an outside area. A licensee with a cafe permit shall maintain dramshop insurance in an amount deemed acceptable by the city, said insurance to show the city as an additional insured. (Ord. 1195, 6-14-2010)
