The purpose of this subchapter is to specify requirements for the establishment, construction, operation and maintenance of a cable system in the city pursuant to the Iowa Code Chapter 364 and applicable federal law. If a new applicant submits a proposal acceptable to the grantor, meets the requirements of this chapter, the requirements of the FCC, and applicable state law the grantor may then proceed to enter into a nonexclusive franchise agreement with the prospective grantee, subject to the provisions of the chapter. If the incumbent operator submits a proposal acceptable under the terms of the Cable Act as amended, and meets the requirements of the FCC, the city shall proceed to fulfill its obligations under § 626 of the Telecommunications Act of 1996, being 47 U.S.C. §§ 521 et seq.
