It is unlawful for any person to make any excavation in or to obstruct any public right-of-way in the city without having first obtained a permit from the City Engineering Department per the requirements of this section. Utilities operating under a franchise granted by the city are also required to obtain a permit. Applicants must obtain one of the following types of permits from the City Engineering Department in order to excavate or obstruct any portion of the right-of-way:
(A) Right-of-way excavation permit. Allows the permittee to excavate or work within a specified city right-of-way, and to hinder free and open passage over the specific portion of the right-of-way per the conditions of this section. Two classifications of permits for this are:
(1) Excavation of an improved section of right-of-way (street, driveway, or sidewalk) for the purpose of constructing or maintaining underground utilities.
(2) Excavation of an unimproved section of right-of-way (grass, gravel, yard, parkway) for the purpose of constructing or maintaining underground utilities.
(B) Temporary street obstruction in the right-of-way permit. Allows the permittee to hinder free and open passage over a specific portion of city street right-of-way without excavating the area.
(C) Trenchless or boring permit. Allows the permittee to bore under right-of-way using trenchless technology for the purposes of installing underground utilities.
(D) Curb cut permit. Allows the permittee to fully remove and replace, or to saw-cut a curb for the purposes of adding a driveway along an improved street with curb and gutter.
(E) Driveway permit. Allows the permittee to replace, maintain, or install a driveway adjacent to the existing roadway within the right-of-way.
(F) Sidewalk permit. Allows the permittee to replace or maintain sidewalks within the right-of-way.
(G) Permanent obstruction in the right-of-way permit. Allows the permittee to erect certain items within the unused portion of the right-of-way.
