(A) Iowa Code and Iowa Administrative Code incorporated. For purposes of this chapter and permits issued thereunder, the provisions of Iowa Code § 321.473, Iowa Code Chapter 321E (Vehicles of Excessive Size and Weight) and applicable regulations contained in Iowa Administrative Code (“IAC”) Agency 761 Chapter 551.1 et seq., are hereby adopted and made applicable to the extent necessary for the issuance of permits under this chapter unless such provisions are directly contradictory to any other provision of this chapter, in which case the Iowa Code or IAC regulation shall be deemed controlling.
(B) Permit-issuing authority. Permits issued under this chapter shall be issued by the City Engineering Department. The City Engineering Department shall also be responsible for creating all application forms and permits required by or issued in accordance with this chapter.
(C) Permit issuance.
(1) Permit required. The Clinton Engineering Department, upon application and good cause being shown therefor, to issue special permits in writing authorizing the applicant to operate or move a vehicle or combination of vehicles of a size or weight or load exceeding the maximum specified by state law, as adopted herein by reference, or city ordinance over those streets named in the permit which are under the jurisdiction of the city and for which the city is responsible for maintenance. All permit applications submitted to the City Engineering Department pursuant to this chapter shall be accompanied by the appropriate application fee, which fees are to be charged in the amounts provided for in the table below. The fees charged for permits issued pursuant to this chapter shall be identical to those assessed by the State of Iowa in accordance with Iowa Code § 321E.14, as amended from time to time. In the event any specific permit fee listed in the table below is reduced by the State of Iowa via amendment to Iowa Code § 321E.14, the fees charged by the city pursuant to this section shall be adjusted accordingly. Failure to submit the appropriate fee with the permit application shall constitute grounds for denial.

(2) Other permits and charges. The city may also charge permit applicants additional fees under certain circumstances as follows:
(a) Fees for the movement of buildings, parts of buildings, or unusual vehicles, or loads may be increased to cover the costs of inspections by the city;
(b) A fee not to exceed $250 per day or a prorated fraction of that fee per person and car for escort service may be charged when requested or when required under this chapter or by Iowa law. Proration of escort fees between the State of Iowa and the city when more than one governmental authority provides or is required to provide escort for a movement during the period of a day shall be determined by applicable provisions of the Iowa Code.
(c) The city may charge a permit applicant for the cost of trimming trees and removal and replacement of natural obstructions or official signs and signals or other public or private property required to be removed during the movement of a vehicle and load. (Iowa Code § 321E.14)
(3) Form of permit and inspection. A permit issued under this chapter shall be in writing or in an electronic format and shall be carried in the cab of the vehicle for which the permit has been issued. Permits issued under this chapter and the vehicle for which the permit has been issued shall be open to inspection at all times by any peace officer or an authorized agent of any permit-issuing authority.
(4) Grounds for denial of permit. When in the judgment of the City Engineering Department the movement of a vehicle with an indivisible load or special mobile equipment which exceeds the maximum dimensions and weights will be unduly hazardous to public safety or will cause undue damage to infrastructure or other public or private property, the permit shall be denied and the reasons for denial endorsed on the application. Permits shall designate the days when and routes upon which loads and special mobile equipment may be moved upon city streets.
