§ 50.02 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CITY OWNED GARBAGE CONTAINER. Those garbage containers which the city purchases and provides to the owners or occupants of residential premises for the placement of garbage for collection by the city.
   CITY OWNED SINGLE-STREAM RECYCLING CONTAINER. Those recycling containers which the city purchases and provides to the owners or occupants of residential premises for the placement of recyclable items for collection by the city.
   CITY OWNED YARD WASTE CONTAINER. Those yard waste containers which the city purchases and provides to the owners or occupants of residential premises for the placement of yard waste for collection by the city.
   COLLECTOR. Any person authorized to gather solid waste from public and private places.
   DIRECTOR. The Director of the State Department of Natural Resources or any designee.

   DISCARD. To place, cause to be placed, throw, deposit or drop.

   DWELLING UNIT. Any room or group of rooms located within a structure and forming a single habitable unit with facilities which are used, or are intended to be used, for living, sleeping, cooking and eating.
   GARBAGE. All solid and semisolid, putrescible animal and vegetable waste resulting from the handling, preparing, cooking, storing, serving and consuming of food or of material intended for use as food, and all offal, excluding useful industrial by-products, and includes all substances from all public and private establishments and from all residences.

   LANDSCAPE WASTE. Any vegetable or plant waste except garbage. The term includes trees, tree trimmings, branches, stumps, brush, weeds, leaves, grass, shrubbery and yard trimmings.

   LITTER. Any garbage, rubbish, trash, refuse, waste materials or debris.

   MOBILE HOME. A transportable structure which exceeds eight feet in width or 32 feet in length, built on a chassis and designed to be used as a dwelling, with or without a permanent foundation. A MOBILE HOME is considered a residential dwelling unit if it is permanently connected to the required utilities.
   OWNER. In addition to the record titleholder, any person residing in, renting, leasing, occupying, operating or transacting business in any premises, and as between the parties the duties, responsibilities, liabilities and obligations hereinafter imposed shall be joint and several.
   RECYCLABLE ITEMS / RECYCLING. Any clean and dry material which is generated as a result of or is a by-product of residential, commercial or industrial activities and which has a market for reprocessing or reuse. Materials considered as recyclable will be determined by the accepting local recycling center.
   REFUSE. Putrescible and non-putrescible waste, including but not limited to garbage, rubbish, ashes, incinerator residues, street cleanings, market and industrial solid waste and sewage treatment waste in dry or semisolid form.

   RESIDENTIAL PREMISES. A single-family dwelling and any multiple-family dwelling up to and including four separate dwelling units.
   RESIDENTIAL WASTE. Any refuse generated on the premises as a result of residential activities. The term includes landscape waste grown on the premises or deposited thereon by the elements, but excludes garbage, tires and trade waste.

   RUBBISH. Non-putrescible solid waste consisting of combustible and non-combustible waste, such as ashes, paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery or litter of any kind.

   SANITARY DISPOSAL. A method of treating solid waste so that it does not produce a hazard to the public health or safety or create a nuisance.

   SANITARY DISPOSAL PROJECT. All facilities and appurtenances including all real and personal property connected with the facilities, which are acquired, purchased, constructed, reconstructed, equipped, improved, extended, maintained or operated to facilitate the final disposition of solid waste without creating a significant hazard to the public health or safety, and which are approved by the Director.

   SOLID WASTE. All garbage, yard waste and recyclable items that are acceptable collectable items. SOLID WASTE may include vehicles, as defined by Iowa Code § 321.1(1).

   YARD WASTE. Any vegetable or plant waste except garbage. The term includes trees, tree trimmings, branches, stumps, brush, weeds, leaves, grass, shrubbery and yard trimmings and excludes tree limbs and yard wastes created by commercial tree service operations. Tree and shrubbery branches must be less than one inch in diameter and 36 inches in length.
