§ 152.04 ENFORCEMENT.
   It shall be required that in accordance with the adopted provisions of the Iowa Code and IAC, the State Fire Marshal, the Fire Chief, and/or a City Code Official, or any of his or her authorized representatives, shall inspect, at the time of any scheduled inspection provided for by city code, the detectors in all dwellings marketed for rent to determine their operability and condition of maintenance. The enforcement officials listed in this section shall have all powers and duties and shall adhere to the limits with respect to those powers and duties, provided for in Iowa Code Chapter 100 and the IAC regulations adopted herein.
   (A)   Failure to install or maintain smoke detectors, carbon monoxide alarms, alarm systems, fire extinguishers or any other violation of any provision of this chapter, shall be punishable in accordance with the provisions of Iowa Code Chapter 100, including those specifically enumerated in Iowa Code § 100.18, and the IAC regulations adopted by reference herein. Nothing in this section shall be construed as limiting the city or state’s ability to seek other civil or criminal penalties for violation of this chapter where such additional or alternative remedies are authorized by other provisions of this code or state law.
   (B)   Any person who violates any provision of this chapter commits a municipal infraction. In addition to the standard penalty set forth in § 10.99 of this code, any owner who permits the occupancy of a dwelling unit after it has been found unfit for human habitation and placarded, as set forth in this chapter, shall commit a municipal infraction and shall, upon conviction, be subject to a fine of $10 per day for each day the dwelling unit is occupied in violation of this chapter. In addition to the standard penalty, any occupant who occupies a dwelling unit after it has been found unfit for human habitation and placarded, as set forth in this chapter, shall be deemed to commit a municipal infraction and shall, upon conviction, be subject to a fine of $10 per day for each day the dwelling unit is occupied in violation of this chapter.
