Any violation of the provisions of this chapter shall be deemed either a municipal infraction or a simple misdemeanor, or both, at the discretion of the city. Each violation shall be considered separate and distinct and in the event it is a continuing violation, each day the violation continues shall be considered a separate and distinct violation. In addition to the aforementioned penalties, the city reserves the right to request that the Department revoke and or suspend the owner/operators permit to operate a tanning facility.
