(A) A person who commits or attempts to commit, conspires to commit or aids or abets in the commission of an act constituting a violation of this chapter, whether individually or in connection with one or more other persons or as principal, agent, or accessory, is guilty of a simple misdemeanor. A person who falsely, fraudulently, forcibly or willfully induces, causes, coerces, permits or directs another to violate a provision of this chapter is guilty of a simple misdemeanor.
(B) The city may, at its option, in lieu of or in addition to seeking criminal penalties, treat non-compliance as a municipal infraction and seek an appropriate court order imposing daily civil penalties, injunctive relief including a cease and desist order, and all other relief allowed by the Clinton Code of Ordinances. Each violation shall be considered separate and distinct and in the event it is a continuing violation, each day the violation continues shall be considered a separate and distinct violation.
(C) Violations of this chapter by any massage therapy business or any owner, manager, employee, or other agent thereof, may, in addition to imposition of the criminal or civil penalties, result in the revocation of the business permit.
