(A) Statement of purpose and findings. The City of Clinton's Urban Revitalization Program ("CURP" or "Program") described in the Amended and Restated Clinton Urban Revitalization Plan, as amended, ("Plan") allows the issuance of property tax exemptions for qualified improvements to qualified real estate within a designated urban revitalization area. The CURP is designed to stimulate private investment by reducing the tax increase that would normally result from making improvements to real property. The City Council finds that the rehabilitation, conservation, re-development, economic development, or a combination thereof, of the revitalization areas designated in the Plan, as amended, and this section, is necessary in the interest of the public health, safety and welfare of the residents of the city and the areas have heretofore been found to substantially meet the criteria of Iowa Code § 404.1.
(B) Designated urban revitalization areas.
(1) The following areas are no longer designated as urban revitalization areas under Iowa Code Chapter 404:
(a) Due the cessation of the Iowa Enterprise Zone Program, the city removed the following enterprise zones from the CURP in 2016: Lincoln Way Enterprise Zone and Central Clinton Enterprise Zone. As such, the Lincoln Way Enterprise Zone and the Central Clinton Enterprise Zone are no longer designated as urban revitalization areas. Two other areas previously identified as enterprise zones are now designated as commercial/industrial revitalization areas; those areas include: Lyons Business and Technology Park Urban Revitalization Area and the Manufacturing Meadows Urban Revitalization Area.
(b) The city previously designated the New Directions Area as a separate urban revitalization area. However, in 2016 the City Council determined that the desired level of revitalization had been attained in that area and therefore the city removed the New Directions Area from the CURP. As such, the New Directions Area is no longer designated as an urban revitalization area.
(c) With the adoption of Amendment No. 1 to the Plan in 2018, the City Council determined that the desired level of revitalization has been attained in two of the commercial/industrial revitalization areas: the Margaret Place Urban Revitalization Area and the Margaret Place East Urban Revitalization Area. Therefore, the city removed the Margaret Place Urban Revitalization Area and the Margaret Place East Urban Revitalization Area from the CURP, and as such, they are no longer designated as urban revitalization areas.
(d) With the adoption of Amendment No. 2 to the Plan in 2021, the city removed the Central Business District Urban Revitalization Area and Lyons Business District Urban Revitalization Area from the CURP, and as such, they are no longer designated as urban revitalization areas.
(2) The following areas are designated as urban revitalization areas under Iowa Code Chapter 404:
(a) City-wide housing revitalization area and housing redevelopment subarea.
1. The city-wide housing revitalization area includes the entire area within the corporate limits of the City of Clinton. The legal description for the area within the corporate limits of the City of Clinton is found in Chapter 35 of the 2005 Code of Ordinances of the City of Clinton, Iowa. Any land annexed into the city in the future shall automatically be included in the city-wide housing revitalization area as of the effective date of the annexation.
2. A subarea within the city-wide housing revitalization area has been identified which contains property that substantially meets the criteria of Iowa Code § 404.1(2). Specifically, the city has found this subarea, referred to as the housing redevelopment subarea, to contain the existence of certain conditions, including a substantial number of deteriorated or deteriorating structures, faulty lot layouts, deterioration of site or other improvements, and the existence of conditions which endanger life or property by fire and other causes; all of which are among the criteria listed in Iowa Code § 404.1(2) for designating an area as blighted. Due the existence of these blighting conditions, the city has determined that legitimate planning objectives, namely the cessation of blighting influences, supports making a more robust exemption schedule available for residential property within this subarea. The housing redevelopment subarea includes the following properties:
a. All of the area contained within the following boundaries: the point of beginning is the centerline of 7th Avenue North at the intersection of the centerline of North 3rd Street; thence following the centerline of 7th Avenue North west to the centerline of North Bluff Blvd. and following the centerline of Bluff Blvd. to the centerline of South 14th Street; thence following the centerline of South 14th Street south to the centerline of Camanche Avenue; thence following the centerline of Camanche Avenue north to the centerline of South 5th Street at the intersection with the centerline of 11th Avenue South; thence following the centerline of 11th Avenue South east to the centerline of South 4th Street; thence following the centerline of South 4th Street north to the centerline of 8th Avenue South; thence following the centerline of 8th Avenue South east to the centerline of South 2nd Street; thence following the centerline of 2nd Street to the centerline of 6th Avenue North; thence following the centerline of 6th Avenue North west to the centerline of North 3rd Street; thence following the centerline of North 3rd Street north to the point of beginning; and
b. Section 30 Township 82 North Range 7 part of SE 1/4 SE SW commencing on point on the west line of tract owned by Skyline Center in center of the north/south concrete roadway; thence N 406.48' to NW corner Skyline Center thence E 423.25' to W line North 4th Street; thence N on W line North 4th Street 879.60' to S line 28th Avenue North thence W 12.19' on said Avenue; long legal description; and
c. All of the area contained within the following boundaries: the point of beginning is the centerline of North 3rd Street at the intersection of the centerline of 25th Avenue North; thence following the centerline of North 3rd Street north to the centerline of 30th Avenue North; thence following the centerline of 30th Avenue North east to the centerline of Garfield Street; thence following the centerline of Garfield Street south to the centerline of 25th Avenue North; thence following the centerline of 25th Avenue North west to point of beginning.
d. In addition, the following lots are also included in this blighted subarea:
i. Buell's Addition, Range 3, Block 8, Lots 1-16;
ii. Buell's Addition, Range 3, Block 7, Lots 9-16;
iii. Buell's Addition, Range 3, Block 6, Lots 9-16;
iv. Buell's Addition, Range 3, Block 5, Lots 9-16;

(C) Duration of designation. The areas designated as urban revitalization areas under this section shall continue as such until the city repeals or amends this section. However, if the City Council determines at any time during the term of the Plan that the desired level of revitalization has been attained or economic conditions are such that continuation of the exemptions granted under the Plan would cease to be of benefit to the city for one or more of the designated revitalization areas, the City Council may amend or repeal the section pursuant to Iowa Code Chapter 404 so as to amend or cancel one or more of the designated revitalization areas. In the event this section or any part thereof is amended or repealed so as to cancel one or more of the designated revitalization areas, all exemptions previously granted under the plan for properties in the cancelled revitalization area(s) shall continue until their expiration.
