§ 97.115 PERMANENT OBSTRUCTION IN RIGHT-OF-WAY.
   Construction of any fence, landscaping, decorative mailbox or handicap ramp within the public right-of-way shall be subject to the permitting requirements of this section. No fence, landscaping, decorative mailbox, or handicap ramp shall be placed in the public right-of-way unless there is sufficient excess right-of-way such that vehicle or pedestrian travel is not impeded by the fence, landscaping, decorative mailbox or handicap ramp. All fences shall be constructed consistent with descriptions contained in the city zoning ordinances applicable to the abutting private property and shall be approved by the City Engineering Department prior to construction. Fences, landscaping, decorative mailboxes or handicap ramps shall not be rooted in the ground in any manner making it impracticable or unduly difficult to remove in case it is necessary for right-of-way maintenance, utility installation, or other public activities. The City Engineering Department shall enforce this section on a case by case basis based upon a policy drafted by the City Engineer.
