(A) If the POTW determines that a generator is responsible for a blockage of a collection system line, the generator shall owe a civil penalty of $500 for the first violation, $750 for a second violation, and $1,000 for the third violation within a two-year period. Continuous violations may result in termination of services.
(B) Any person violating any of the provisions of this subchapter shall be subject to a written warning for the first violation, a $500 civil penalty for the second violation, a $750 civil penalty for the third violation, and a $1,000 civil penalty for the fourth violation within a two-year period. Consistent violations may result in termination of service as per § 52.041.
(C) Any person or entity who fails to comply with § 52.038(A)(1) by June 30, 2020 shall be subject to a penalty of $50 for each day of non-compliance. After July 31, 2020, daily fines assessed under this division shall cease and any person or entity not in compliance with § 52.038(A)(1) shall be subject to termination of service pursuant to § 52.041, in addition to any other penalties provided for in this chapter, the Iowa Code, or any applicable federal laws or regulations.
