§ 98.04 PERMIT REQUIRED.
   (A)   No person shall plant, remove, or trim, other than routine trimming, or in any way affect the general health or structure of a parkway tree without first obtaining a permit. There is no charge for this permit. Violation of the terms of a permit, or this chapter shall be grounds for suspension or revocation of such permit, in addition to any penalty provided in this chapter. Upon completion of the work the holder of the permit shall restore the parkway or median to a condition similar to that which existed prior to the work.
   (B)   Any person desiring a permit to plant, remove, or trim, other than routine trimming, any tree in any parkway shall submit a written application to the City of Clinton setting forth:
      (1)   A drawing of the area showing pavement, streets, sidewalks, curbs and gutters with a definite indicated scale.
      (2)   The number, location, and variety of trees to be planted, trimmed, other than routine trimming, or removed.
      (3)   The number, location, and variety of trees already existing in the area.
      (4)   Such other information as the City of Clinton shall find reasonably necessary to make a fair determination of whether a permit should be issued.
   (C)   The City of Clinton shall issue a permit under this section provided the application meets the requirements of §98.05 and the intended planting does not create a nuisance, hazard, or misuse of city property. A permit issued hereunder shall expire 60 days from the date of issuance.
