(A) (1) There are three types of development classification: staged development; major development; and minor development; each of which is defined above at § 158.01 of this chapter. The classification assigned to a development determines the procedures and steps which must be taken by a developer to secure final plat approval for his or her development. Regardless of the classification, public hearing and other procedural requirements may also apply if the development involves replatting.
(2) The three types of development are briefly described in this section and are more specifically addressed under § 158.35 of this chapter.
(1) Staged development.
(a) A developer of a staged development, as defined above at § 158.01 of this chapter, shall file and secure approval of a preliminary plat and a final plat or plats.
(b) He or she has the option of filing for the approval of both the preliminary and final plats at the same time.
(c) He or she is required to secure approval of the preliminary and final plats by the Commission and the Council.
(2) Major development.
(a) A developer of a major development, as defined above at § 158.01 of this chapter, need only file and secure approval of a final plat, except where public improvements are to be constructed, in which event, preliminary plat approval is also required.
(b) He or she has the option of filing for approval of both the preliminary, if any, and final plats at the same time.
(c) He or she is required to secure approval of the preliminary plat, if any, and the final plat by the Commission and the Council.
(3) Minor development.
(a) A developer of a minor development, as defined above at § 158.01 of this chapter, need only file and secure approval of a final plat, by the Building Official.
(b) He or she is allowed, but not required, except under certain circumstances, to proceed as a major development.
