§ 70.01  DEFINITIONS.
   (A)   The definitions provided in Tex. Transportation Code Ch. 541 are adopted as a part of this section as if set out at length in this section.
   (B)   For the purpose of this traffic code, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      AUTHORIZED DRIVER. A person who is at least 18 years of age or possesses a valid state driver’s license.
      BICYCLE. A human-powered vehicle with two wheels in tandem, designed to transport, by a pedaling action, a person or persons.
      CONTROL-ACCESS HIGHWAY. A highway or roadway to which:
         (a)   Persons, including owners or occupants of abutting real property, have no right of access; and
         (b)   Access by persons to enter or exit the highway or roadway is restricted under law except at a place and in the manner determined by the authority that has jurisdiction over the highway or roadway.
      CURB LOADING ZONE. A space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.
      DRIVER. As used in reference to a vehicle, a person who drives or has physical control of a vehicle.
      ELECTRIC BICYCLE. As defined by Tex. Transportation Code § 541.201(24), means a bicycle that:
         (a)   Is designed to be propelled by an electric motor, exclusively or in combination with the application of human power;
         (b)   Cannot attain a speed of more than 20 mph without the application of human power; and
         (c)   Does not exceed a weight of 100 pounds.
      FREIGHT CURB LOADING ZONE. A space adjacent to a curb for the exclusive use of vehicles during the loading or unloading of freight.
      GOLF CART.  A motor vehicle designed by the manufacturer primarily for transporting persons on a golf course.
      MANUAL. The Texas Manual on Uniform Traffic-Control Devices for Streets and Highways, Volumes I and II.
      MOTOR VEHICLE. Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails.
      NEIGHBORHOOD ELECTRIC VEHICLE (NEV).  Tex. Transportation Code Ch. 551, Subchapter D shows NEVs on city streets with a speed limit of 45 miles an hour or less, unless a city prohibits them. NEVs are larger than golf carts, but smaller than most passenger vehicles. The Federal Motor Vehicle Safety Standard requires that NEVs be equipped with headlamps, stop lamps, turn signal lamps, tail lamps, reflex reflectors, parking brakes, rear view mirrors, windshields, seat belts and vehicle identification numbers. In any case, the law governing NEVs is separate from the law governing golf carts.
      OFFICIAL TRAFFIC-CONTROL DEVICES. All signs, signals, markings and devices not inconsistent with this traffic code placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic.
      PASSENGER CURB LOADING ZONE. A place adjacent to a curb for the exclusive use of vehicles during the loading or unloading of passengers.
      PUBLIC HIGHWAY.  Has the meaning assigned by Tex. Transportation Code § 502.001, as amended. Any road, street, avenue, or bridge, within the city not privately-owned or within the exclusive control or jurisdiction of the state.
      SLOW-MOVING VEHICLE EMBLEM.  Has the meaning assigned by Tex. Transportation Code § 547.703.
