§ 53.35  PRETREATMENT; REQUIREMENTS; BYPASS.
   (A)   Bypass of pretreatment facilities.
      (1)   Bypass is prohibited, except to prevent loss of life, personal injury or severe property damage when no feasible alternatives exist.
      (2)   The user may allow bypass to occur which does not cause effluent limitations to be exceeded, but only for essential maintenance to assure efficient operations.
      (3)   Notification of bypass shall be made as follows.
         (a)   Anticipated bypass. If the user knows in advance of the need for a bypass, it shall submit prior written notice, at least ten days before the date of the bypass, to the city.
         (b)   Unanticipated bypass. The user shall immediately notify the city and submit a written notice to the POTW within five days. The report shall specify:
            1.   A description of the bypass and its cause, (including the time, duration, volume and location of the bypass and the type and concentration of waste in the bypass);
            2.   Whether the bypass has been corrected; and
            3.   The steps being taken or to be taken to reduce, eliminate and prevent a recurrence of the bypass.

   (B)   Pretreatment requirements.
      (1)   If discharges or proposed discharges to public sewers may adversely affect wastewater facilities, processes, equipment or receiving waters; create a hazard to life or health; or create a public nuisance, the control authority shall require:
         (a)   Pretreatment;
         (b)   Control over the quantities and rates of discharge; and
         (c)   Payment for the cost of handling and treating wastes.
      (2)   The control authority may determine whether a discharge or proposed discharge is included under division (B)(1) above.
      (3)   The control authority shall deny discharge of wastes when:
         (a)   A discharge or proposed discharge is included under division (B)(1) above; and
         (b)   The discharger does not meet all pretreatment requirements imposed.
