(A) A permit shall be obtained from the town to reserve the use of any park facilities and said permit shall give the permittee priority usage of the reserved facility over any other user.
(B) An application for a permit to reserve any part of the park shall be filed with the town at least one week preceding the requested use date. No permit shall be valid for dates in excess of six months from the date of the permit application unless approved by the Town Council. Permits may be renewed by the town at the Town Manager’s discretion and upon permittee request. When a permit is approved, the town shall immediately notify the Chief of Police of the dates of use, type of activity and the number in the group.
(C) A permit issued pursuant to this chapter shall allow the permittee to use the premises only as authorized by the terms of the permit.
(D) RV park:
(1) Use of all RV park facilities requires a valid permit;
(2) No RV park permit exceeding three continuous days shall be issued to any person, unless otherwise authorized;
(3) All persons using the RV park shall register with the designated town representative upon arrival at the RV park; and
(4) Subleasing RV park spaces is prohibited.
(E) Notice of cancelled permits must be received by the town 48 hours prior to the reserved date. The permittee shall be responsible for all charges established under the permit for failing to provide such notice.
(F) A permit shall be revocable by the town for a permittee’s violation of any park rule, town ordinance or state statute applicable to the use of the park.
(G) The permittee shall accept the premises as is and shall restore the premises used to the same condition at the expiration of the permit. The permittee shall make no changes or alterations of the premises without the prior written approval of the Town Manager. The permittee shall be responsible for removing litter and trash from the area to suitable trash containers or off the premises.
(H) The permit fee includes the right of the permittee to use electricity from one electrical outlet 110 volts, 15 amps) in the area specified in the permit. The fee does not include any special services, equipment, clean-up, indoor facilities or staff personnel.
(I) (1) The permittee shall agree, in writing, to indemnify the town for any and all damage to park facilities and property and against all liability and damage to any person for injuries, including death, whether or not the damage was caused by the permittee, or by his or her patrons, guests or invitees.
(2) The permittee shall assume full responsibility for damage to the facility, plants and equipment and shall immediately report any loss or damage of park property to the town.
(J) Organized activities sponsored by the town shall have priority for use of park facilities. All other organized activities may be permitted at the Town Manager’s discretion.
(K) The Town Manager shall have the authority to make minor additions and modifications to the permit agreement as may be reasonably necessary to accommodate particular uses.
