(A) The Town Council shall, by resolution and as deemed necessary, set all park fees and establish usage priorities, including usage priorities between types and classes of users when such priorities are lawful and, in the judgment of the Council, promote usage that is beneficial to the town.
(B) In the event that the Town Manager determines that the prevailing schedule of fees and charges or the park permit form is not in the best interests of the town because of the nature, scope, uniqueness, public benefit or significance of a particular proposed event, the Town Manager may negotiate the terms of an agreement between the town and the permittee. All such negotiated agreements shall be at the direction of the Town Council and subject to its approval.
(C) The Town Manager or Public Works Director may make such reasonable rules and regulations as are necessary to manage, use, preserve and govern the park and the activities which are the subject of this chapter.
(D) All resolutions passed under this section and copies of all rules and regulations promulgated by the Town Manager or Public Works Department, shall be on file at the Town Clerk’s office for public inspection. Copies of such resolutions and rules and regulations shall also be maintained on file in the office of the Town Manager, Public Works or recreation facility to which the resolutions and rules and regulations apply.
