(A) (1) The town shall review and revise the total annual cost of operation and maintenance as well as each user’s contribution percentages on an annual basics to assure equity of the service charge system established in this subchapter.
(2) The user charges will be reviewed to accomplish the following:
(a) Maintain the proportionate distribution of operation and maintenance costs among users, and user classes as required in this subchapter;
(b) Generate sufficient revenue to pay the total operation and maintenance costs for the wastewater system; and
(c) Apply excess revenue collected from a class of users to the cost of operation and maintenance attributable to that class for the next year and adjust the rate accordingly.
(B) The town shall notify each user annually, in conjunction with a regular bill, of the user charge rate and that portion of the user charges or ad valorem taxes which are attributable to wastewater treatment services.
(C) If a major user, such as an industry as defined above, changes the user’s contribution percentages by discharging into the town’s wastewater system, the user can present at a regularly scheduled meeting of the Council factual information concerning his or her discharges to the system. The town shall then determine any necessary changes in contribution percentages. The town shall notify the users of its findings as soon as possible. The town shall provide, on an annual basis, a breakdown of sewer revenues and costs, and information as to how the individual user charges were computed.
(D) Monies transferred from other revenue sources to meet temporary shortages in the operation and maintenance account will be repaid following appropriate adjustments in the user charges identified for the operation and maintenance account.
