Commodities shall be exempt from the provisions of this chapter when:
(a) Packaged in quantities measuring less than twenty eight grams (28 g) (one ounce (1 oz)) or twenty nine milliliters (29 ml) (one fluid ounce (1 fl oz)), or when the total retail price, excluding applicable tax, is fifty cents ($0.50) or less.
(b) Only one (1) brand and size of a commodity is offered for sale in the retail establishment;
(c) The commodity is:
(1) Infant formula and the unit price is provided on the reconstituted volume of the product.
(2) Medicine sold by prescription only.
(3) Beverages subject to packaging or labeling requirements imposed under the Federal Alcohol Administration Act, as amended.
(4) Food sold for consumption on premises.
(d) The commodities are required to be marked individually with a unit price under the laws of this State.
