§ 94.30 APPEAL.
   (A)   At any time before expiration of the ten day notice of violation period referenced in § 94.99 (C), the property owner or driveway permit petitioner may request a hearing before the Village Council to appeal the finding of the Public Works Director that a violation(s) exists. The Village Council shall consider the evidence presented at such hearing and shall either revoke the initial order, issue a final order which differs from the initial order, or reinstate the initial order as a final decree.
   (B)   Any request for a hearing must be in writing and filed in the Village Hall. The Village Manger shall fix a time for the hearing, notify the petitioner of the scheduled hearing date and time. The initial abatement order shall be temporarily suspended pending such hearing. The hearing will be held by the Village Council during the next regularly scheduled council meeting as a business item during the regular agenda business section. At the hearing, the individual affected by the order shall be given the opportunity to present evidence to refute the findings which supported the notice of violation.
