§ 150.056 ELECTRICAL BOARD — CREATED; POWERS AND DUTIES; APPEALS.
   (A)   Membership. There is created an Electrical Board, composed of the Building Official and five resident's of the city. The latter membership shall consist of two master electricians, one journeyman electrician, and two persons who are known to have an interest in community affairs. The Building Official shall serve as an ex officio member without voting privileges and as the Secretary of the Board.
   (B)   Term of office; compensation. The City Council shall originally appoint the five members, who shall draw for one and two-year first terms of office. Thereafter the term of office of each such member shall be for a period of two years or until his successor shall have been appointed. The City Council may remove any member, and its decision thereon shall be final. Members shall not serve for more than two consecutive terms and shall serve without compensation.
   (C)   Quorum. Three members of the Electrical Board present at any meeting shall constitute a quorum for the transaction of business or the carrying out of any duties. All decisions and recommendations of the Board shall require a concurring vote of at least three members.
   (D)   Disqualification of journeyman member. Employment of the journeyman electrician member of the board by either master electrician of the Board for as long as two consecutive months shall automatically disqualify the journeyman electrician from further membership on the Board, and a successor shall be appointed forthwith to serve the remainder of the term of such disqualified member.
   (E)   Absences from meetings. The absence of any Board member from the regularly scheduled meeting of the Board for three consecutive meetings shall automatically disqualify such member from further membership on the Board, and a successor shall be appointed forthwith to serve the remainder of the term of such disqualified member.
   (F)   Records of proceedings to be kept and filed. The Electrical Board shall keep records of its proceedings and decisions and file copies of these records with the office of the City Secretary and the Building Official.
   (G)   Rules governing meetings. The Electrical Board shall have the power to make and promulgate its own rules governing its meetings and proceedings, including selection of a Chairperson.

   (H)   Powers and duties. The Electrical Board has the following powers and duties:
      (1)   Hear appeals from decisions of the Building Official or Electrical Inspector and reverse, affirm or modify the decision appealed from, or make such order or determination as in its opinion ought to be made.
      (2)   Interpret applicable provisions of this code; and
      (3)   Hear and make recommendations to the City Council concerning requests for amendments to this code.

   (I)   Appeal procedure.
      (1)   The Electrical Board shall hear the appeals of persons aggrieved by orders or decisions made by the Electrical Inspector to the Building Official and shall render a decision on each appeal.
      (2)   The appeal shall be filed in writing with the City Secretary within five days from the date of the decision or orders appealed from. Such appeal shall be in duplicate, shall refer to the specific decision or order appealed from and shall clearly state the appellant's grounds for appeal. The City Secretary shall notify the Chairperson of the Electrical Board of all appeals filed. Such appeals shall be placed on the agenda of the Electrical Board for hearing. The Board shall notify all necessary parties of the date and location of the hearing. Parties may appear before the Electrical Board in person, by agent or by attorney. Appeals shall be heard at reasonable times at the convenience of the Board but not later than 30 days after receipt thereof. The appellant shall cause to be made at his or her own expense any tests or research required by the Board to substantiate his or her claims.
      (3)   The appellant shall be required to pay a fee of $25 per appeal.
      (4)   The Building Official and Electrical Inspector shall transmit to the Electrical Board all records and dates in their possession which are relevant to the appeal.
      (5)   All orders or decisions made by the Building Official or Electrical Inspector shall remain in full effect until such time as the Board revokes such order or decision or until such time as the City Council amends the provisions of this code.
      (6)   The Building Official shall enforce and execute all legal decisions and orders of the Electrical Board.
      (7)   Any person who may feel himself or herself aggrieved by any action or decision of the Board may, within 30 days after receiving notice of the Board's final order, file suit in a district court of the county, to correct any error of law in such decision. Such suit shall be filed against the Board as defendant, and service of process may be made upon the Board by serving the City Secretary.
