§ 130.05 LOUDSPEAKERS — USE ON OR NEAR STREETS.
   (A)   It shall be unlawful for any person to use or operate, or cause to be used or operated, any mechanical or electrical device, machine, apparatus or instrument to intensify or to amplify or to reproduce the human voice, or any other sound, on any public street within the city corporate limits.
   (B)   It shall be unlawful for any person to use or operate, or cause to be used or operated, any mechanical or electrical device, machine, apparatus or instrument to intensify, amplify or reproduce the human voice, or any other sound in any building or on any premises in the city, whereby the sound therefrom is cast directly upon the public streets or places or where such device is maintained and operated for advertising purposes or for the purpose of attracting the attention of the passing public, or which is so placed or operated that the sound coming therefrom can be heard to the annoyance or inconvenience of travelers upon any street or public place, or of persons in neighboring premises.
   (C)   Any person desiring to use a device to intensify or amplify the voice or sound in broadcasting a speech, speaking or program matters of public interest, and not of a strictly advertising nature, or a series of speeches or programs on matters of public interest not of a strictly advertising nature, may apply to the Chief of Police for a special permit to do so. Upon such application being presented, the chief of police shall investigate same and if he finds that such speech, speaking or program is a matter, of public interest, and will not result in annoyance or inconvenience to travelers upon any street or public place or persons in neighboring premises, he may, in his discretion, grant such permit. A fee of $1 shall be paid for making such investigation at the time the application is filed, whether the permit. is granted or not, which fee shall be placed in the general fund of the city. If such application is for the broadcasting of a series of speeches, speakings or programs, the Chief of Police shall present same to the City Council, together with his findings and recommendations, for the approval of the council and, if the council approves same, the permit shall be issued for the series of speeches or programs, but if the Council does not approve same, the permit shall be refused.
   (D)   The purpose of this section is to prevent any noise on any public street which is reasonably calculated to disturb the peace and good order of the neighborhood or of the persona owning, using or occupying property adjacent to such public streets.
