§ 118.11 PRIVATE ROADS AND DRILL SITES.
   (A)   Prior to the commencement of any drilling operations, all private roads used for access to the drill site and the operation site must be at least ten feet wide, have an overhead clearance of 14 feet, and be surfaced with asphalt, asphalt millings, crushed rock, or gravel, and maintained to prevent dust and mud. A concrete approach shall be installed at the entrance of any access road off all streets or roadways. Applicable permits shall be obtained from the Inspection Department. The operator shall provide a minimum of prime coat with four-inch depth of asphalt millings from the concrete approach to the pad site and around heavily traveled areas on the pad site or as may be required by the Public Works Director or his designee. All mud and debris tracked onto city streets shall be removed immediately.
   (B)   It is the operator's responsibility to make sure that such private roads meet these requirements. In particular cases, the requirements governing surfacing of private roads may be altered at the discretion of the City Manager after consideration of all circumstances, including but not limited to the following:
      (1)   The distances from public streets and highways;
      (2)   The distances from adjoining and nearby property owners whose surface rights are not leased by the operation;
      (3)   The purpose for which the property of such owners is or may be used;
      (4)   Topographical features;
      (5)   The nature of the soil; and
      (6)   Exposure to wind.
