(A) Established. There is hereby established a police reserve force to be known as the Cleburne Police Reserve, such force to be separate and distinct from the Police Department.
(B) Regulation by Chief of Police.
(1) The Chief of Police shall be the head of the Police Reserve, and the members of the Reserve shall be under the authority, control and command of the Chief of Police, subject to all of the provisions of the City Charter, ordinances of the city, and laws of the state.
(2) The Chief of Police may, by order, establish rules and regulations governing the Police Reserve, to fix specific duties of its members, and to provide for the maintenance of discipline.
(C) Composition. The Police Reserve shall be composed of personnel who have volunteered to join the organization, and whose applications have been accepted by the Chief of Police. The total strength of the Police Reserve shall not exceed 30 members.
(D) Appointment. The Chief of Police shall appoint the members of the Police Reserve. Members serve at the Chief's discretion. Application for membership in the Police Reserve shall be filed with the Police Department on a form prescribed by the Chief of Police. Selections of eligible applicants chosen to serve as Reserve Police Officers are subject to state and local rules for the appointment of peace officers. Reserve Police Officers are appointed under Tex. Loc. Gov't Code Chapter 341, and are not entitled to civil service status under Tex. Loc. Gov't Code Chapter 143.
(E) Duties. The duties of the Police Reserve, subject at all times to the direction and supervision of the Chief of Police, shall be to assist the regular members of the Police Department in the enforcement of law and maintenance of peace and order, when assigned duty by the Chief of Police. The Chief of Police may call the Police Reserve into service at any time the Chief considers it necessary to have additional officers to preserve the peace and enforce the law. Reserve Police Officers shall act only in a supplementary capacity to the regular police force. When assigned to duty, members of the Police Reserve will be under the control and supervision of the regular police force when carrying out their duties. The chain of command established for the Police Department shall be strictly adhered to by members of the Police Reserve.
(F) Powers and authority.
(1) On approval of the appointment of a member who is a peace officer as described by Article 2.12, Tex. Code of Criminal Procedure, the Chief of Police may authorize the person appointed to carry a weapon or act as a peace officer at all times, regardless of whether the person is engaged in the actual discharge of official duties.
(2) No person appointed to the Cleburne Police Reserve may carry a weapon or otherwise act as a peace officer until such person has been approved by the City Council.
(G) Identification and uniforms. The Chief of Police shall prescribe the uniforms and badges for members of the Police Reserve Force and direct the manner in which the same shall be worn. The badge and identification card issued to members of the Police Reserve Force by the Police Department shall be carried at all times by members of the Police Reserve Force.
(H) Compensation and benefits. Members of the Police Reserve may be compensated for the performance of their official duties. Compensation shall be commensurate with their official duties. The Chief of Police shall have the authority to establish a rate of pay, if any, for the Police Reserve. The city may provide hospital and medical assistance to a member of the Police Reserve who sustains injury in the course of performing official duties in the same manner as provided for full-time police officers.
(I) Termination of membership.
(1) Membership of any person in the Police Reserve may be terminated by the Chief of Police at any time for any cause, and any member may resign from the Police Reserve at any time, but it shall be the duty of the Reserve Officer to notify the Chief of such resignation.
(2) In addition to the penalties provided by law, any violation of law under color of the performance of duty as a member of the Police Reserve, and any breach of the rules and regulations established by the Chief of Police, shall subject any member of the Police Reserve to summary expulsion and the fact may be published at the order of the Chief of Police.
