§ 105.02 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AGRICULTURAL VENDOR. Any person who distributes, offers for sale, or sells one or more of the following products: fruits, vegetables, plants, flowers, herbs, hay, firewood, homemade soaps, herbal oils, value added products intended for consumption, and fresh eggs meeting the Texas Department of State Health Services requirements. Value added products intended for human consumption include jams, jellies, honey, baked goods that do not require refrigeration such as cakes cookies, breads, pastries, candy, coated and uncoated nuts, unroasted nut butters, fruit butters, fruit pies, dehydrated fruits and vegetables, and dried beans.
   APPLICANT. A person who has filed a formal written application with the city for the purpose of obtaining a special event permit.
   ARTIST/CRAFTSPERSON VENDOR. A person who distributes, offers for sale, or sells personally handcrafted, hand created, or handmade goods.
   CITY. The City of Cleburne, Texas.
   CODE OFFICIAL. The person or department to whom the City Manager may, from time to time, delegate the enforcement responsibility under this chapter.
   FOOD VENDOR. Any person who distributes, offers for sale, or sells food which is prepackaged or prepared on-site.
   LEASE SPACE. The individual areas within the Market Square designated by the city as places to be used by vendors.
   PERMIT HOLDER. The person to whom a special event permit is granted pursuant to this chapter.
   PROMOTER. Any individual, assumed-named entity, partnership, association, corporation, firm or organization that promotes, organizes, manages, finances or holds a special event.
   SPECIAL EVENT. A temporary event or gathering held at Market Square for a common purpose under the direction or control of a promoter or permit holder. The term includes, but is not limited to, any activity involving entertainment and/or amplified sound, food, beverage, merchandise sales or any activity promoted as a festival, trade show open to the public, craft show, public dance, fund raiser, concert, or performance.
   SPECIAL EVENT PERMIT. A permit issued by the city to a promoter to conduct a special event.
   STREET. Any public or private street, alley, avenue, lane, boulevard, drive, public place or highway commonly used for the purpose of travel within the city.
   UNCOVERED AREAS. Those lease spaces which are not covered by the provided metal awning.
   VENDOR. Any person who sells, distributes, or offers for sale products permitted by this chapter.
   WARE VENDOR. A person who distributes, offers for resale, or sells wares other than; agricultural products sold by an agricultural vendor, food products sold by a food vendor, or handcrafted or handmade goods sold by an artist/craftsperson.
