§ 52.02  GENERAL PROVISIONS; COLLECTION CONTRACTS.
   (A)   The Town Council may cause solid waste and recyclables to be collected, removed, and/or disposed by town employees; or the Town Council may contract with any person, firm or corporation for collection, removal, and disposal of the same.  If solid waste and recyclables are to be collected, removed, and disposed by contract, the Town Council shall advertise for bids for the “collection, removal, and disposal of solid waste and recyclables” as often as deemed advisable by the Town Council.
   (B)   The contract shall be awarded to the lowest responsible bidder and the Town Council reserves the right to reject any and all bids.  This chapter shall be considered and made a part of the contract for the work.  All bids for the “collection, removal, and disposal of solid waste and recyclables” shall be signed and sealed and shall be accompanied by a bond or certified check in the sum equal to 10% of the total annual contract price as a guarantee of good faith on the part of the bidder that he or she will enter into the contract.  All bids provided for in this chapter shall be placed on file in the office of the Town Clerk-Treasurer not later than 2:00 p.m. on the day the same are to be opened by the Town Council.
   (C)   The Town Council shall give notice by publication as required by Indiana Code § 5-3-1 et seq. as amended from time to time.  The Town Council shall open the bids at the next regular meeting succeeding the publication.  Upon the acceptance of any bid or bids by the Town Council, the successful bidder shall thereafter enter into a contract with the town under the terms and conditions of this chapter for a term of one year or for a longer period of time if deemed advisable by the Town Council and the check or bond of unsuccessful bidder(s) shall thereupon be returned.  Every person with whom the town enters into a contract for the collection, removal, and disposal of solid waste and recyclables shall file with the Town Clerk-Treasurer a bond with one sufficient surety approved by the Town Council, conditioned for the faithful performance of his or her contract and duties as provided and defined in this chapter and upon the filing of the bond his or her check or bond deposited with the bid shall be returned.
