For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ANIMAL. Any and all types of animals, both domesticated and wild, male and female, singular and plural.
AT LARGE. Off the premises of the owner, and not under the control of the owner or a member of the owner’s immediate family, either by leash, cord, chain, electric collar, or under the control of a responsible person and immediately obedient to that person’s commands.
ELECTRIC COLLAR. A collar that will deliver an electric shock by remote control or when used in conjunction with an electric fence.
ELECTRIC FENCE. A device that utilizes an underground boundary line that will generate an electric shock to an animal that has a corresponding electric collar.
OWNER. Any person, firm, corporation, organization or department possessing or harboring or having the care or custody of an animal.
PUBLIC NUISANCE. Any animal which:
(1) Molests passersby or passing vehicles;
(2) Attacks other animals or residents;
(3) Is repeatedly at large;
(4) Damages private or public property or injures any person; or
(5) Barks, whines or howls in an excessive, continuous or untimely fashion.
RESPONSIBLE PERSON. The owner, family member, or a designated person to whom the animal immediately responds in an obedient manner.
RESTRAINT. Any animal secured by a leash, cord, chain, electric collar, electric fence, or under the control of a responsible person and obedient to that person’s initial commands in all situations when confronting other animals or people or within the real property limits of the owner and the corresponding lake waters. Cats are exempt from this definition, but must not become a public nuisance.
